Privacy is not something to leave until later
Many agents postpone privacy matters because they sound technical and do not directly contribute to the next deal. That is understandable, but risky.
The GDPR applies to anyone processing personal data about people in the EU. As an estate agent, you do this daily: prospects' names and contact details, buying preferences, financing circumstances and sometimes copies of identity documents. This data needs protection, and you are responsible for processing it properly.
What the GDPR specifically requires of agents
The key practical points:
Purpose limitation: Only use customer data for the purpose for which it was collected. An email address left with a property enquiry is not consent to your newsletter.
Data minimisation: Collect only what you really need. If a postcode is enough for your search, you do not need the prospect's full address.
Right of access: If a contact asks what data you hold about them, you must be able to trace and disclose it. This requires a structured system.
Erasure obligations: Data you no longer need must be deleted. That also requires knowing where it is stored.
Why server location matters in practice
The GDPR allows transfers to third countries outside the EU only under certain conditions, for example where the European Commission has recognised an adequate level of protection or standard contractual clauses have been agreed.
In practice, if a service stores your customer data on servers outside Europe, you need a legal basis for that transfer. This is often missing or undocumented.
This is not purely theoretical: European courts and data protection authorities have repeatedly reviewed and restricted transfers to the US for years. If you rely on a service with US servers, you share that risk.
European hosting: what it means and what it does not
A service with European hosting stores your data on EU servers, usually in Germany, Austria, the Netherlands or similar countries. This removes the third-country issue.
However, that does not automatically mean everything else is in order. A European-hosted service can still provide inadequate security or lack clear processing agreements. Also check:
- Is a data processing agreement (DPA) available?
- Is it clearly documented what happens to your data?
- Can you export data or have it deleted?

- Check where your current tools are hosted. Reading the privacy policy or sending the provider a short email is often enough.
- Make sure you have a DPA with every service that processes customer data for you.
- Document whose data you collect and why. A record of processing activities is generally required for agencies because they regularly process personal data, and provides a useful foundation for independent agents too.
Privacy is not something you finish once and forget. It is not impenetrable either. With suitable tools and some structure, you can manage the essentials properly.
